1. Agreement to Terms
By accessing or using Dirgha AI ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These terms constitute a legally binding agreement between you and Dirgha LLC, a United States limited liability company that operates the Service (referred to in these Terms as "we", "us", or "Dirgha AI").
2. Service Description
Dirgha AI provides an AI-powered platform for research, writing, and commerce applications. Our Service includes access to AI models, content generation tools, and related features. Credits represent consumable AI tokens used to access platform features. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. Account Registration
You must be at least 13 years of age to use the Service. By registering, you represent that you meet this age requirement. Each user is limited to one account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep this information updated.
4. Subscription Plans & Billing
We offer subscription plans: Pro (₹1,699/$20 per month), Build (₹8,499/$100 per month), and Scale (₹16,999/$200 per month). All subscriptions are billed monthly and automatically renew unless cancelled. We process payments through Stripe and Razorpay. By subscribing, you authorise us to charge your payment method on a recurring basis. Prices are subject to change with 30 days notice. You are responsible for all applicable taxes.
5. Refund Policy
Consumed AI credits are non-refundable under any circumstances. For subscription fees, unused subscription days may be refunded pro-rata within 7 days of the charge if requested and no credits have been consumed. To request a refund, email [email protected] with your account details and reason. Refunds are at our discretion and may take 5–10 business days to appear in your account.
6. Donations
Contributions made through the /contribute page — whether by Razorpay (UPI, cards, Net Banking), Stripe (cards), on-chain Bitcoin, or Lightning — are voluntary, one-way donations to Dirgha LLC. All donations are final and non-refundable under any circumstances. Donations are not purchases of goods or services, are not tax-deductible at present, and confer no right, entitlement, warranty, service-level commitment, or equity interest in Dirgha LLC or its products. By submitting a donation, you confirm that you send the funds voluntarily and expect nothing in return. Funds are allocated per the published protocol split (Guild workers, upstream maintainers, sovereign fund, operations).
7. Cancellation Policy
You may cancel your subscription at any time from account Settings → Billing. Upon cancellation, access continues until the end of your current billing period. No partial refunds are given for unused days in the current period (see Refund Policy for the 7-day exception). Your data is retained for 30 days after cancellation, then permanently deleted. You may export your data at any time before deletion.
8. Acceptable Use
You agree not to use the Service for any illegal purpose or to generate illegal content. Abusing AI systems — including attempts to jailbreak, manipulate, or overload models — is prohibited. Scraping, data mining, or automated access without written permission is prohibited. You may not infringe intellectual property rights, harass others, or distribute malware. Violations may result in immediate account termination.
9. Intellectual Property
You retain ownership of all content you create using the Service. Dirgha AI retains all rights to the platform, including software, algorithms, trademarks, and trade secrets. We grant you a limited, non-exclusive, non-transferable licence to use the Service during your subscription period. Feedback you provide may be used by us without obligation or compensation.
10. Limitation of Liability
To the maximum extent permitted by law, Dirgha LLC's liability is limited to the amount you paid us in the preceding 3 months. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. This limitation applies regardless of the theory of liability.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, where Dirgha LLC is formed. Any disputes shall be subject to the exclusive jurisdiction of the courts of Delaware.
12. Entity
The Service is operated by Dirgha LLC, a United States limited liability company. Throughout these Terms, "Dirgha AI" refers to the product and brand; "Dirgha LLC" refers to the legal entity that owns and operates it.
